1. Who We Are

Creators Market is operated by Chell Technologies Ltd., a company registered in Nigeria. We run a creator marketplace platform that connects brands with content creators across African markets.

For the purposes of applicable data protection law, Chell Technologies Ltd. is the data controller responsible for your personal data.

2. Data We Collect

We collect different categories of data depending on whether you use the Platform as a Brand or as a Creator.

2.1 Account & Identity Data

Data you provide when registering or setting up your profile:

  • Full name or business name
  • Email address
  • Password (stored as an encrypted hash — never in plain text)
  • Country of residence or operation
  • Profile photo or company logo
  • Phone number (optional, used for payment verification)
  • Industry or content niche

2.2 Brand-Specific Data

If you register as a Brand, we additionally collect:

  • Company registration details (where provided for verification)
  • Campaign briefs, creative assets, and budget information
  • Target audience specifications (age range, gender, location, interests)
  • Campaign performance instructions and feedback on Creator deliverables

2.3 Creator-Specific Data

If you register as a Creator, we additionally collect:

  • Social media handles and linked account information (platform, handle, follower count — entered manually at MVP stage)
  • Content niche and audience demographics (as self-reported)
  • Portfolio links and bio
  • Ad Reshaping Score and performance tier
  • Campaign application history and deliverable submissions

2.4 Payment & Financial Data

  • Bank account details or mobile money numbers (for Creator payouts)
  • Payment card details (for Brand deposits — processed and stored by our payment partners; Creators Market does not store raw card data)
  • Transaction history, amounts, currencies, and payout statuses
  • Tax identification numbers (where required by applicable law)

2.5 Communications Data

  • Messages exchanged between Brands and Creators via the Platform’s messaging system
  • Support requests submitted to our team
  • Notifications sent and read status
  • Email and SMS communications with Creators Market

2.6 Usage & Technical Data

Collected automatically when you use the Platform:

  • IP address and approximate geolocation
  • Browser type and version
  • Device type and operating system
  • Pages visited, features used, and time spent on the Platform
  • Referral source (how you arrived at the Platform)
  • Error logs and crash reports

3. How We Collect Your Data

We collect your data through the following means:

  • Directly from you — when you register, complete your profile, create or apply for campaigns, submit deliverables, make or receive payments, or contact our support team.
  • Automatically — through cookies, server logs, and analytics tools as you browse and use the Platform.
  • From third parties — from payment processors (Flutterwave, Paystack) regarding transaction status; from authentication providers (Google OAuth) when you choose to sign in with a third-party account.
  • From other users — Brands may provide information about Creators when creating campaigns or submitting feedback on deliverables.

4. How We Use Your Data

We use your personal data for the following purposes:

4.1 Platform Operations

  • Creating and managing your account
  • Facilitating campaign creation, application, and management
  • Processing payments, managing escrow, and releasing payouts
  • Calculating and updating your Ad Reshaping Score
  • Enabling Brand-Creator messaging and notifications
  • Delivering email, SMS, and in-app communications relating to your activity

4.2 Safety & Trust

  • Verifying the identity of users and linked social accounts
  • Detecting and preventing fraudulent activity, fake metrics, and platform abuse
  • Investigating disputes and enforcing our Terms and Conditions
  • Monitoring for prohibited conduct and policy violations

4.3 Platform Improvement

  • Analysing usage patterns to improve the Platform’s features and design
  • Identifying bugs, errors, and performance issues
  • Conducting internal research and product development
  • Testing new features with consenting user groups

4.4 Marketing & Communications

  • Sending you updates about new Platform features (you may opt out at any time)
  • Sharing aggregated, non-identifiable insights with the public or partners (e.g. “creators on our platform average X% engagement”)
  • Responding to your enquiries and support requests
  • Complying with applicable laws and regulatory obligations
  • Responding to lawful requests from government authorities or courts
  • Protecting Creators Market’s legal rights and interests

We process your personal data on the following legal grounds, in accordance with the Nigeria Data Protection Act (NDPA) 2023 and other applicable frameworks:

Where we rely on legitimate interests, we have assessed that our interests are not overridden by your rights and freedoms. You may object to processing based on legitimate interests at any time (see Section 10).

Where we rely on consent, you may withdraw that consent at any time without affecting the lawfulness of processing carried out before withdrawal.


6. Data Sharing & Disclosure

We do not sell your personal data. We share it only in the following circumstances:

6.1 Between Platform Users

  • When a Creator applies for a campaign, their profile (including display name, niche, social handles, and Ad Reshaping Score) is visible to the relevant Brand.
  • When a Brand creates a campaign, their brand name, industry, and campaign brief are visible to Creators browsing the marketplace.
  • Messages sent through the Platform are visible only to the sender and recipient.

6.2 Payment Partners

We share necessary financial data (name, account details, transaction amount) with our payment processing partners — currently Flutterwave and Paystack — to facilitate transactions. These partners operate under their own privacy policies and are bound by data processing agreements with us.

6.3 Service Providers

We engage trusted third-party service providers who process data on our behalf under strict contractual obligations:

6.5 Business Transfers

In the event of a merger, acquisition, or sale of all or a portion of our assets, your data may be transferred to the acquiring entity. We will notify you via email and a prominent Platform notice before your data becomes subject to a different privacy policy.


7. Cookies & Tracking Technologies

We use cookies and similar technologies to operate and improve the Platform.

7.1 What Are Cookies

Cookies are small text files placed on your device by a website. They allow us to remember your preferences, keep you logged in, and understand how you use the Platform.

7.3 Managing Cookies

You can control cookies through your browser settings. Note that disabling essential cookies will prevent you from logging in or using core Platform features. For analytics and marketing cookies, you may also opt out through the cookie preference centre available in the Platform’s settings.


8. Data Retention

We retain your personal data only for as long as necessary for the purposes described in this policy.

When data is no longer required, we securely delete or anonymise it. Anonymised data (which cannot identify you) may be retained indefinitely for analytics purposes.

If you request account deletion, we will process your request within 30 days, subject to any outstanding legal or financial obligations that require us to retain certain records.


9. Data Security

We take the security of your data seriously and implement the following measures:

  • Encryption in transit: All data transmitted between your browser and our servers is encrypted using TLS (HTTPS).
  • Encryption at rest: Sensitive data, including passwords (stored as bcrypt hashes) and financial details, is encrypted at rest.
  • Access controls: Access to personal data is restricted to authorised personnel on a need-to-know basis. All access is logged and audited.
  • Payment security: Raw payment card data is never stored on our servers. Card processing is handled entirely by PCI-DSS compliant partners (Flutterwave, Paystack).
  • Infrastructure security: Our hosting infrastructure is protected by Cloudflare’s DDoS mitigation, firewall rules, and regular security patching.
  • Incident response: We maintain a data breach response plan. In the event of a breach affecting your personal data, we will notify you and the relevant regulatory authority within 72 hours of discovery, where required by law.

No system is completely secure. While we work hard to protect your data, we cannot guarantee absolute security and encourage you to use a strong, unique password and to contact us immediately if you suspect unauthorised access to your account.


10. Your Rights

Depending on your location, you may have the following rights regarding your personal data. We honour these rights for all users regardless of jurisdiction.

10.1 Right to Access

You have the right to request a copy of the personal data we hold about you. We will provide this within 30 days of your request.

10.2 Right to Rectification

You have the right to correct inaccurate or incomplete personal data. You can update most profile information directly through your account settings.

10.3 Right to Erasure

You have the right to request deletion of your personal data where it is no longer necessary for the purposes it was collected, or where you withdraw consent. Certain data may be retained where we have a legal obligation to do so (see Section 8).

10.4 Right to Data Portability

You have the right to receive your personal data in a structured, commonly used, machine-readable format (JSON or CSV) for transfer to another service.

10.5 Right to Restriction

You have the right to request that we restrict processing of your data in certain circumstances — for example, while a dispute is being investigated.

10.6 Right to Object

You have the right to object to processing based on legitimate interests, including profiling and direct marketing. We will cease such processing unless we can demonstrate compelling legitimate grounds.

Where processing is based on consent, you may withdraw that consent at any time. This does not affect the lawfulness of processing before withdrawal.

10.8 How to Exercise Your Rights

We will respond within 30 days. We may need to verify your identity before processing your request. There is no fee for exercising your rights, though we reserve the right to charge a reasonable administrative fee for manifestly unfounded or excessive requests.

If you are unsatisfied with our response, you have the right to lodge a complaint with the Nigeria Data Protection Commission (NDPC) or the relevant data protection authority in your jurisdiction.


11. Children’s Privacy

The Creators Market platform is not directed at individuals under the age of 18. We do not knowingly collect personal data from children. If you believe a minor has registered on the Platform without parental consent, please contact us at privacy@creators-market.xyz and we will promptly delete the account and associated data.


12. International Data Transfers

Creators Market is based in Nigeria and primarily serves African markets. However, some of our infrastructure and service providers are located in other countries, including the United States and the European Union.

Where we transfer your data outside of Nigeria, we ensure appropriate safeguards are in place, including:

  • Data processing agreements incorporating standard contractual clauses
  • Transfers only to countries or organisations that offer an adequate level of data protection
  • Compliance with the cross-border transfer provisions of the NDPA 2023

By using the Platform, you acknowledge that your data may be processed in countries outside your own. We take all reasonable steps to ensure your data remains protected to the standard described in this policy regardless of where it is processed.


The Platform may contain links to third-party websites, social media platforms, or services. This Privacy Policy does not apply to those third-party services. We encourage you to review the privacy policies of any third-party services you access through our Platform.

We are not responsible for the data practices of third-party platforms, including Instagram, TikTok, YouTube, or X (Twitter), even where Creators link their accounts to our Platform.


14. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or applicable law. When we make material changes, we will:

  • Post the updated policy at creators-market.xyz/privacy
  • Update the Effective Date at the top of this document
  • Notify you via email and/or a prominent in-app notice at least 14 days before the changes take effect

Continued use of the Platform after the effective date of any updated policy constitutes your acceptance of the revised terms. We recommend reviewing this policy periodically.
